1. Who these Terms apply to
These Terms of Service apply to your use of the Ingeno website at ingeno.app and the BullionPulse mobile application. BullionPulse is provided by MRB Ocean Limited trading as Ingeno. In these Terms, Ingeno, we, us and our refer to MRB Ocean Limited trading as Ingeno.
By accessing the website, downloading BullionPulse, using BullionPulse or purchasing a BullionPulse subscription where subscriptions are available, you agree to these Terms. If you do not agree to these Terms, you should not use the website or BullionPulse.
2. About BullionPulse
BullionPulse is a premium precious-metals portfolio and market-tracking application. It provides precious-metals price tracking, portfolio tracking, performance calculations, alerts and market information.
BullionPulse is not a brokerage, trading platform, investment adviser, regulated financial adviser, exchange, custodian, wallet or payment service. BullionPulse does not execute trades, arrange trades, hold assets, custody metals, provide personal financial advice or make investment recommendations.
3. No investment, financial, tax or legal advice
BullionPulse is provided for information, tracking and calculation purposes only. Content, prices, calculations, alerts, charts and market information in BullionPulse are not investment advice, financial advice, tax advice, legal advice or a recommendation to buy, sell, hold or trade any asset.
You are responsible for your own financial decisions. Before making investment, tax, legal or financial decisions, you should consider your own circumstances and seek advice from an appropriately qualified professional if needed.
4. Market data and calculations
BullionPulse relies on third-party market-data providers and BullionPulse-controlled infrastructure to provide precious-metals market information. Market prices, exchange rates, calculations, chart values, alerts and portfolio performance outputs may be delayed, unavailable, inaccurate, incomplete or affected by technical issues.
The app may display market status wording such as "Live · ~10m delay" or "1d delay" to indicate the current data position. These labels are informational and do not make BullionPulse a real-time trading feed, brokerage service or guaranteed market-data provider.
You should not rely on BullionPulse as the only source for pricing, valuation, trading, tax, accounting or financial decision-making. We do not guarantee that market data, calculations or alerts will always be accurate, complete, current or available.
5. Local portfolio data
BullionPulse stores portfolio data locally on your device at launch. Ingeno does not store your portfolio data on its servers and does not have access to your locally stored portfolio information.
You are responsible for maintaining your device, backups and any records required for your own financial, tax, accounting or personal purposes. Deleting the app, clearing device data, changing devices or operating-system behaviour may result in loss of locally stored BullionPulse information.
6. Accounts
BullionPulse does not use Ingeno user accounts at launch. There are no usernames, passwords or Ingeno account-recovery processes for BullionPulse at launch. Where subscriptions are available, subscription access is intended to be managed through Apple App Store, Google Play and RevenueCat entitlement systems rather than an Ingeno login system.
7. Subscriptions and Premium features
BullionPulse may offer Free and Premium functionality. Premium access is intended to be provided through auto-renewing subscriptions purchased through Apple App Store or Google Play. Subscription access is planned to be managed using a RevenueCat Premium entitlement.
Subscription pricing, renewal periods, trial eligibility, tax treatment and available payment methods are shown by Apple App Store or Google Play before purchase. Storefront prices may vary by country, currency, tax treatment, platform rules and promotional availability.
Further subscription terms are set out in the BullionPulse Subscription Terms. If there is a conflict between these Terms and the Subscription Terms about subscription-specific matters, the Subscription Terms apply to the extent of that conflict.
8. Acceptable use
You must use the website and BullionPulse lawfully and responsibly. You must not misuse the app, interfere with the service, attempt to bypass subscription controls, reverse engineer restricted parts of the service except where permitted by law, overload or attack infrastructure, scrape or resell market data, use the service for unlawful purposes, or attempt to access systems or data that you are not authorised to access.
You must not use BullionPulse in a way that breaches applicable law, infringes rights, undermines security, misrepresents the service, or attempts to turn BullionPulse into a trading, advice or regulated financial service.
9. Intellectual property
The website, BullionPulse, Ingeno branding, BullionPulse branding, interface designs, copy, software, graphics, product concepts and related materials are owned by or licensed to Ingeno, except for third-party materials and platform components. You receive a limited, personal, non-transferable licence to use BullionPulse in accordance with these Terms and applicable app-store terms.
You may not copy, distribute, modify, resell, sublicense, exploit or create derivative works from BullionPulse or the website except where expressly permitted by these Terms or applicable law.
10. Third-party services and app-store terms
BullionPulse depends on third-party platforms and services, including Apple App Store, Google Play, RevenueCat, Cloudflare and market-data providers. Your use of BullionPulse may also be subject to Apple App Store terms, Google Play terms, device operating-system terms and third-party service terms.
We are not responsible for third-party platforms, payment systems, store policies, outages, price changes, tax treatment, refund decisions, subscription-management interfaces or data-provider availability beyond our reasonable control.
11. Availability and changes
We aim to provide a reliable and useful service, but we do not guarantee that the website, BullionPulse, market-data access, alerts, calculations, subscriptions or Premium features will always be available, uninterrupted or error-free. We may update, change, suspend or discontinue features where reasonably necessary for product, security, legal, commercial or operational reasons.
We may release updates through Apple App Store or Google Play. Some features may require an up-to-date app version, operating-system version, active internet connection or active subscription.
12. Alerts and notifications
BullionPulse may provide price-alert and portfolio-value alert functionality. Alerts are for convenience only and must not be treated as guaranteed, time-critical or investment-decision tools. Alerts may be delayed, missed, unavailable or affected by device settings, network connectivity, market-data availability, operating-system behaviour, background-app restrictions or future notification settings.
Push notifications are not enabled at launch. Alerts are foreground-only in the current build and are evaluated while the app is open. If push notifications are introduced later, additional settings, permissions and privacy information may apply.
13. Disclaimers
BullionPulse and the website are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties, representations and conditions that are not expressly stated in these Terms, including implied warranties of accuracy, availability, fitness for a particular purpose, non-infringement and uninterrupted operation.
Nothing in these Terms limits rights that cannot lawfully be limited, including mandatory consumer rights that apply to you.
14. Limitation of liability
To the maximum extent permitted by law, Ingeno is not liable for investment losses, trading losses, financial decisions, missed opportunities, loss of profits, loss of data, loss of portfolio records, business interruption, indirect loss, consequential loss, or losses arising from market-data errors, delayed alerts, service outages, third-party platforms or your reliance on BullionPulse as a decision-making tool.
Where liability cannot be excluded, our liability is limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
15. Support
For BullionPulse support, contact [email protected]. We will aim to respond reasonably, but support availability may vary. Please do not send payment-card details, passwords, private keys, sensitive personal information or unnecessary financial records when requesting support.
16. Privacy
Our Privacy Policy explains how we handle information in connection with the website and BullionPulse. You should read it together with these Terms.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the effective date above. If changes are material, we will take reasonable steps to bring them to your attention through the website, the app or store-release notes as appropriate. Your continued use of the website or BullionPulse after updated Terms take effect means that you accept the updated Terms.
